Alberta Court of Appeal upholds injunction to stall random drug testing at Suncor

An injunction stalling Suncor's random drug and alcohol testing being upheld by the Alberta Court of Appeal.

Communications Energy and Paperworkers Union Local 707 called the pilot project unconstitutional, bringing their case through the courts to ensure the privacy of members wouldn't be violated.

Appeal court justice Jack Watson concluded the possible negative effects on worker's privacy is a greater concern than Suncor's claims workplace safety would be compromised.

Lawyers for the oil giant argued the random testing was crucial for workplace safety, because of numerous incidents of illegal narcotics being found on site.

Non-unionized workers were subject to random testing as of mid October.
