Dunvegan Gardens Hoping To See An End To Land Use Battle

Dunvegan Gardens will be counting on the community’s support in the coming weeks.

On Tuesday, council will hear the first reading of a proposed Land Use Bylaw and Area Structure Plan amendments allowing them permission to sell goods on the land, submitted by VP of Operations Brad Friesen.

Last year, the RMWB argued Dunvegan was operating with no development permits for a greenhouse while using their property for commercial landscaping.

Friesen tells Fort McMurray News if successful – the amendments would allow Dunvegan to legally support commercial properties on their land.

"I want to just put all this stuff behind me. I am tired of SDAB's and I'm tired of dealing with the planning department. I would like to have a business-as-usual type mentality the way most people in this city have."

Back in September of 2016, Dunvegan was handed a stop-work order which was appealed quickly after – allowing them to continue operations.

The Draper area, where Dunvegan Gardens is located, has two land use designations within its boundaries: Country Residential and Small Holdings.

The intent of these designations is to provide a larger lot while maintaining a quiet, rural atmosphere.

Friesen says he hopes council sees the logic in approving the application.

"When I put up a Quonset, I could put it up in a day and I could take them down in a day. What do we call the ones at the SuperStore or ‘Michelle's Independent’ in Timberlea when they pop up a greenhouse for 180 or 120 days? What is that?! To me, that's a temporary structure."

A public hearing on Dunvegan will be held on May 8.

Council will meet tonight at 6 p.m., in the council chambers.
